State laws vary as to the requirements for property disclosure, rental agreements, vacation rentals, and so forth. Before you begin, you may wish to review the requirements of your state. For example, did you know that some states (such as North Carolina) require a seller to provide a disclosure statement of the condition of their home to a prospective buyer before he/she makes an offer? If this is not done prior to the buyer submitting his/her offer, the buyer may be able to rescind the contract. This requirement applies to "FSBO" (For Sale By Owner) listings as well.

While the marketing of commercial property may not require a written disclosure to prospects, a seller, seller agent, landlord, or landlord agent has an obligation to be fair in the representation of any property offered for sale or lease. Notwithstanding, a home buyer, buyer agent, tenant, or buyer tenant agent should be diligent and exercise a reasonable level of care when inspecting a property of interest.
